China adapts third revision copyright law.
- Chinese Standing Committee of the National People’s Congress (NPC) adopted in November 2020 the third amendment of the Chinese Copyright Law. The Copyright Law incorporated administrative regulations on copyright and aligned itself with international conventions. This new law will come into force on the 1st of June 2021.
- Apart from the broadcasting rights that have been expanded, it is worrisome that ownership of IP for creators incline now towards investors. As a principle, the new law stipulates that producers, not the creators, enjoy copyright with regard to audiovisual works other than for films and television plays.
- Infringement of copyright increased 10x and will be monitored by Copyright collective management organizations.
- The new law tries to balance the interests between creators, users and investors, but comparing to the Creafree Universal standard for Intellectual Property, they have still a long way to go in China.
